By accessing our website at www.loftysfurniture.co.uk or purchasing any products from us, you agree to be bound by these Terms and Conditions in their entirety. If you do not agree with any part of these Terms and Conditions, you must not use our website or place an order with us.

1.1 Our website www.loftysfurniture.co.uk is operated by Lofty's Furniture ("we", "us", "our"). Our principal place of business is located at Unit D, 429–431 Wick Lane, London, E3 2JG.
1.2 You can contact us by email at info@loftysfurniture.co.uk. We aim to respond to all enquiries within 3 working days.
1.3 These Terms and Conditions apply exclusively to purchases made through our website at www.loftysfurniture.co.uk. Separate terms apply to any in-store purchases. Please speak to a member of our team in-store for further details.
2. Definitions
2.1 In these Terms and Conditions, the following definitions apply:

3.2 These Terms and Conditions may be updated from time to time. The version in force at the time you place your order will govern that transaction. We recommend that you review these Terms and Conditions periodically.
3.3 You must be at least 18 years of age to place an order on our website. By placing an order, you confirm that you are at least 18 years old and legally capable of entering into a binding contract.
3.4 These Terms and Conditions do not affect your statutory rights as a consumer under English law.

4.4 We reserve the right to suspend, restrict, or terminate your access to our website at any time without notice if we believe you have breached any of these Terms and Conditions or if we consider it necessary for technical, security, or legal reasons.
4.5 We do not guarantee that our website will be available at all times. Access to our website may be temporarily suspended without notice for maintenance, upgrades, or reasons beyond our control.
4.6 Our website is directed at users in the United Kingdom. We make no representation that the content of our website is appropriate or legally available for use in other jurisdictions. If you access our website from outside the United Kingdom, you do so at your own risk.
5. Product Information and Availability
5.1 We take all reasonable steps to ensure that product descriptions, dimensions, materials, colours, and images displayed on our website are accurate. However, we cannot guarantee that the colours you see on your screen accurately reflect the true colour of the products, as this may vary depending on your device and display settings.
5.2 All products are subject to availability. We reserve the right to withdraw any product from sale at any time without notice and without liability to you.
5.3 In the event that a product you have ordered becomes unavailable after your order has been placed, we will notify you as soon as reasonably practicable and offer you the choice of a suitable alternative, a credit note, or a full refund.
5.4 Product dimensions provided on our website are approximate. Minor variations may occur due to the handcrafted or semi-handcrafted nature of certain furniture items. We strongly encourage you to verify measurements against your intended space before placing your order.
5.5 We reserve the right to make changes to product specifications, materials, and designs without prior notice, provided such changes do not materially affect the quality or fitness for purpose of the goods.
6. Pricing
6.1 All prices displayed on our website are in pounds sterling (£) and include VAT where applicable, unless otherwise stated.
6.2 Delivery charges are not included in the product price and will be displayed separately during the checkout process.
6.3 We reserve the right to change our prices at any time. Price changes will not affect orders that have already been confirmed by us.
6.4 In the event of a pricing error on our website, we reserve the right to cancel your order and issue a full refund. We will notify you of any such error as soon as possible.
6.5 Promotional prices, discount codes, and special offers are subject to their own individual terms and conditions and may be withdrawn or amended at any time without notice. Discount codes cannot be applied retrospectively to orders already placed.
6.6 We are not obliged to honour any price that is clearly erroneous, even if an order confirmation has been issued.
7. Orders and Contract Formation
7.1 By placing an order on our website, you are making an offer to purchase goods from us subject to these Terms and Conditions. An order placed by you does not constitute a binding contract until we have confirmed acceptance of your order.
7.2 Once you have submitted your order, you will receive an automated acknowledgement by email. This acknowledgement is confirmation that we have received your order and does not constitute acceptance of it.
7.3 A binding contract is formed when we issue a formal order confirmation email confirming that your order has been accepted and processed. We reserve the right to decline any order at our absolute discretion, including where goods are unavailable, where payment cannot be processed, or where we suspect fraudulent activity.
7.4 It is your responsibility to ensure that all information provided at the time of ordering — including your name, delivery address, contact details, and payment information — is accurate and complete. We accept no liability for delays or failed deliveries resulting from inaccurate or incomplete information provided by you.
7.5 Once an order has been confirmed, amendments may not be possible. Please contact us at info@loftysfurniture.co.uk as soon as possible if you need to make changes to your order, and we will endeavour to accommodate your request where we reasonably can.
8. Payment
8.1 Full payment is required at the time of placing your order. We accept payment by the methods displayed at checkout, which may include major debit and credit cards and other payment providers.
8.2 All transactions are processed securely through our payment providers. We do not store your full card details on our systems.
8.3 By submitting payment, you confirm that you are the authorised holder of the payment method used, or that you have the explicit permission of the authorised holder to use it.
8.4 If payment cannot be processed or is declined for any reason, we reserve the right to cancel your order and will notify you accordingly.
8.5 In the event of a fraudulent transaction or chargeback dispute, we reserve the right to pursue recovery of funds through all available legal channels, including but not limited to the courts of England and Wales.
9. Delivery
9.1 We offer our own in-house delivery service within London for a flat fee of £49. Delivery outside of London is not currently offered directly by Lofty's Furniture. Customers requiring delivery outside of London are responsible for arranging their own third-party courier service.
9.2 Our team will contact you within 5 working days of your order being confirmed to arrange a suitable delivery date.
9.3 We aim to deliver your order within 15 working days from the date your delivery slot is confirmed. All delivery timescales are estimates only and are not guaranteed. We shall not be liable for delays caused by circumstances beyond our reasonable control, including adverse weather, traffic conditions, or third-party logistics failures.
9.4 It is your responsibility to ensure that adequate access is available at the delivery address on the agreed delivery date, including unobstructed entrances, hallways, staircases, and doorways. If you have any concerns about access, you must notify us in advance.
9.5 If no one is available to receive the delivery at the agreed time and location, a redelivery fee may apply. We accept no liability for any loss or inconvenience arising from a failed delivery due to your unavailability.
9.6 Risk in the goods passes to you upon delivery. You should inspect the goods at the point of delivery and notify us within 3 working days of any damage or defect.
9.7 Title to the goods passes to you only upon receipt of full payment.
9.8 We reserve the right to deliver goods in instalments where items are ordered together but are not available for simultaneous delivery. Each instalment shall constitute a separate delivery under this Agreement.
10. Collection from Warehouse
10.1 You may elect to collect your order from our warehouse at Unit D, 429–431 Wick Lane, London, E3 2JG, by prior arrangement.
10.2 Collection must be agreed at the time of ordering. We cannot guarantee that goods will be available for collection without prior notice.
10.3 Risk in the goods passes to you at the point of collection. We accept no responsibility for any damage that occurs to goods after they have been collected from our premises.
11. Cancellation Rights
11.1 As a consumer purchasing goods online, you have the right under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 to cancel your order within 14 days of receiving your goods, without giving any reason. We voluntarily extend this cancellation period to 15 days for your convenience.
11.2 To exercise your right to cancel, you must notify us in writing by email to info@loftysfurniture.co.uk before the expiry of the cancellation period.
11.3 Following cancellation, you must return the goods to us or arrange for collection within a reasonable time. A collection fee of £49 will be deducted from your refund for change-of-mind cancellations. This fee does not apply where the goods are faulty, damaged on arrival, or not as described.
11.4 The statutory right to cancel does not apply to custom-made or made-to-order goods, or to goods that have been assembled or installed. Please refer to our Refund and Exchange Policy for full details.
11.5 Original delivery charges are non-refundable on change-of-mind cancellations unless the entire order is cancelled before dispatch.
12. Returns and Refunds
12.1 Our Refund and Exchange Policy, available at www.loftysfurniture.co.uk, forms part of these Terms and Conditions and is incorporated herein by reference.
12.2 If you receive goods that are faulty, damaged, or not as described, you must notify us within 3 working days of delivery by emailing info@loftysfurniture.co.uk with your order number and clear photographic evidence of the issue.
12.3 Where a valid claim is made under clause 12.2, we will arrange a free collection and offer a full replacement or refund, including any original delivery charges paid.
12.4 Refunds will be processed to the original payment method within 7 business days of our receipt and inspection of the returned goods. We accept no responsibility for delays caused by your bank or payment provider.
12.5 Nothing in this clause affects your statutory rights under the Consumer Rights Act 2015.
13. Guarantee
13.1 All products purchased through our website are covered by our 2-Year Frame Guarantee from the date of delivery, subject to the terms set out in our Furniture Guarantee policy, available at www.loftysfurniture.co.uk.
13.2 The guarantee covers manufacturing defects in the structural frame only and does not extend to fabric, fillings, cushions, surface finishes, or damage arising from misuse, neglect, or normal wear and tear.
13.3 The guarantee is non-transferable and applies to the original purchaser only.
13.4 The guarantee does not affect your statutory rights under UK consumer law.
14. Intellectual Property
14.1 All content on our website, including but not limited to text, images, graphics, logos, product photographs, design elements, and software, is the intellectual property of Lofty's Furniture or its licensors and is protected by applicable copyright, trademark, and other intellectual property laws.
14.2 You may not reproduce, copy, distribute, republish, upload, post, or transmit any content from our website in any form or by any means without our prior written consent, except for your own personal, non-commercial use.
14.3 Nothing in these Terms and Conditions grants you any licence or right to use our trademarks, trade names, logos, or brand elements without our express prior written permission.
14.4 If you believe that any content on our website infringes your intellectual property rights, please contact us at info@loftysfurniture.co.uk with full details of your claim.
15. Limitation of Liability
15.1 To the fullest extent permitted by law, Lofty's Furniture shall not be liable for any indirect, incidental, special, or consequential loss or damage arising out of or in connection with your use of our website or the purchase of our products, including but not limited to loss of profit, loss of revenue, loss of data, or loss of business opportunity.
15.2 Our total liability to you in respect of any claim arising under or in connection with these Terms and Conditions shall not exceed the total price paid by you for the goods giving rise to the claim.
15.3 Nothing in these Terms and Conditions shall limit or exclude our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, any breach of the terms implied by the Consumer Rights Act 2015, or any other liability that cannot be limited or excluded by law.
15.4 We do not warrant that our website will be free from errors, viruses, or other harmful components. You are responsible for ensuring that your device and software are adequately protected.
15.5 We accept no liability for any loss or damage arising from your reliance on information contained on our website that is inaccurate, incomplete, or out of date.
16. Privacy and Data Protection

19. Force Majeure
19.1 We shall not be liable for any failure or delay in performing our obligations under these Terms and Conditions where such failure or delay is caused by circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, fire, flood, pandemic, epidemic, civil unrest, strikes, government action, or failure of third-party suppliers or logistics providers.
19.2 In the event of a force majeure event, we will notify you as soon as reasonably practicable and will use all reasonable endeavours to resume performance of our obligations as quickly as possible.
19.3 If a force majeure event continues for a period exceeding 30 days, either party may terminate the affected order by written notice, and we will issue a full refund of any sums paid by you in respect of that order.
20. Complaints
20.1 We are committed to providing a high standard of service. If you are dissatisfied with any aspect of your purchase or our service, please contact us in the first instance at info@loftysfurniture.co.uk, providing your order number and a full description of your complaint.
20.2 We aim to acknowledge all complaints within 3 working days and to resolve them within 14 working days where possible.
20.3 If you are not satisfied with our response to your complaint, you may seek independent advice from Citizens Advice (www.citizensadvice.org.uk) or refer your dispute to an alternative dispute resolution (ADR) scheme. Further information on ADR is available from the Chartered Trading Standards Institute at www.tradingstandards.uk.
20.4 Nothing in this clause affects your right to bring legal proceedings in the courts of England and Wales.
21. Severability
21.1 If any provision of these Terms and Conditions is found by a court of competent jurisdiction to be invalid, unlawful, or unenforceable, that provision shall be deemed severed from the remainder of these Terms and Conditions, which shall continue in full force and effect.
22. Waiver
22.1 Our failure to enforce any right or provision of these Terms and Conditions shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by an authorised representative of Lofty's Furniture to be effective.
23. Entire Agreement
23.1 These Terms and Conditions, together with our Privacy Policy, Cookie Policy, Refund and Exchange Policy, Furniture Guarantee, and Shipping and Delivery Policy, constitute the entire agreement between you and us in relation to your use of our website and the purchase of our products, and supersede all previous agreements, representations, and understandings between the parties.
24. Governing Law and Jurisdiction
24.1 These Terms and Conditions and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of England and Wales.
24.2 You and we both agree to submit to the exclusive jurisdiction of the courts of England and Wales to resolve any legal dispute arising out of or in connection with these Terms and Conditions.
